1. PURCHASES

Customers may place online orders using our secure shopping cart, or by calling 1 (206) 229-9754. We accept Visa and Mastercard.

Products with 1-2 weeks estimated arrival time and all services must be paid in full at the time of the order. Products with longer lead time will be charged when product is ready for shipment. Once an order is placed, customers will be sent an emailed confirmation, an order number, an itemized description, and important shipping information. If any information needs correction, contact us at customerservice@lawyeravenue.com. We can correct errors if they are reported within a day of placing the order.

Volume pricing is available on some products. As a test of the product, we invite you to purchase one item and we will honor that order as part of quantity volume order and credit your account at time of your purchase.

Sample fabric and leather cuttings for our seating collections are available upon request. Requesting fabric samples will delay estimated lead times. Send requests to customerservice@lawyeravenue.com.

2. SHIPPING

We offer free shipping for all our products within the continental United States. With the exception of books, we cannot ship outside the US, or to PO Boxes.

Based on the size and weight of the merchandise, some items will be shipped via common carriers, and others via USPS or UPS.

Regardless of the shipping method, LawyerAvenue will track and confirm all deliveries. For questions about order status, email us at customerservice@lawyeravenue.com. Delivery times will vary from product to product; some products are stocked are shipped from our warehouse in Seattle WA, while other merchandise is drop-shipped from other cities, or is custom/made-to-order. We’ve done our best to estimate the lead time on the product pages. However, these are estimates only, and are subject to change based on the discretion of the manufacturer or artist. The following is estimated time of arrival for our products:

* For inventoried stock and drop-ship items: 1 – 2 weeks unless otherwise indicated on the product page.
* Custom/made-to-order: 3-6 weeks unless otherwise indicated on the product page.
* Note: if you have special delivery needs (e.g., target dates that need to be met, or a rush request), email us at customerservice@lawyeravenue.com. We’ll do our best to accommodate your request.

3. DELIVERY OF LARGE ITEMS

Large items shipped via professional freight carrier are subject to special delivery guidelines. Prior to delivery, a carrier scheduling agent will call to establish a time of delivery during regular business hours only (Monday through Friday). Depending on the scale of the item, additional fees may occur if manufacturer can only ship to loading docks closest to customer address. In the event of additional delivery charges, we will connect with you before placing your order for your approval of such charges.

You need to make sure someone is present to receive and inspect your order, and to make note on the freight bill if there are any shortages, damages, or if there are any rips in the packaging. When in doubt, state on your freight bill “pending inspection” before signing it. You are responsible for taking these actions in order to process freight/product damage claims if needed, or if your order is missing parts/components. Note: signing your name without any written comments mean that your delivery arrived in perfect condition, and thus carrier will not honor a damage claim.

Drivers of large item deliveries are not responsible for unpacking, assembling, or installing merchandise. If assistance is needed, or there are special needs – or yours is considered a “hard-to-reach” destination, email us at customerservice@lawyeravenue.com, special arrangements can be made but may be subject to additional fees. It is also the customer’s responsibility to inform us if theirs is a destination where full-size trucks would have difficulty in navigating. In this case, the freight company will need to be informed beforehand.

4. FREIGHT DAMAGE

If, when your order arrives, it appears to have been damaged in transit, notify us at customerservice@lawyeravenue.com, or call 1 (206) 229-9754 for instructions. We will provide prepaid return authorization, and request that you return the damaged item in its original packaging so that a claim can be filed. At the same time, your order will be replaced.

If, when your order is delivered, there appears to be a manufacturing defect, email us at customerservice@lawyeravenue.com, or call 1 (206) 229-9754 for instructions. Please do NOT contact the manufacturer; certain procedures need to be followed under such circumstances.

5. RETURNS

At Lawyer Avenue, we want you to be satisfied with your purchase. However, since some of our items are made-to-order, or have special conditions, our return policies vary based on the product/order:

* We CANNOT accept returns on made-to-order/custom orders, unless there was damage in shipment, or an error on the order. In such cases, you will need to contact us immediately at customerservice@lawyeravenue.com or call 1 (206) 229-9754 for instructions.

* Where merchandise needs to be returned, customers must notify Lawyer Avenue within seven days of the item’s delivery. Merchandise must be returned prepaid in “as-new” condition, and in its original packaging, undamaged and unused. The customer’s credit card will be credited for the amount less a 20 percent re-stocking fee to handle such returns.

* You are responsible for shipping and insurance for all items accepted for return. A refund will not be credited to your credit card until the item is returned, and we can confirm its “as-new” condition.

* Pet products are not returnable due to hygiene issues.

* We cannot accept returns on personalized items.

* Quantity items can be returned only if there is a shipping damage or manufacturing defect, and only items that have been damaged due to shipping or defected due to manufacturing defects will be eligible for return. For example, if in an order of six computer keyboards one was damaged during transportation, or had a manufacturing defect, Lawyer Avenue would replace the one keyboard. Aside from these special circumstances, we cannot accept returns on quantity orders.

6. PROPRIETARY INFORMATION

Lawyer Avenue is a product/trademark of Avenue Productions, Inc. Whenever “Lawyer Avenue” is mentioned it is to be assumed as Avenue Productions, Inc.

All materials on this site, including, without limitation, names, logos, trademarks, service marks, images, articles, graphics, photographs, illustrations, artwork, and other elements making up the Service are protected by copyrights and other intellectual property rights owned and controlled by Lawyer Avenue or by other parties that have licensed their material to Lawyer Avenue.

The Content of this Web site, and the site as a whole, is intended solely for personal, noncommercial use by the users of our site. You may download, print and store selected portions of the Content, provided you (1) only use these copies of the Content for your own personal, non–commercial use, (2) do not copy or post the Content on any network computer or broadcast the Content in any media, and (3) do not modify or alter the Content in any way, or delete or change any copyright or trademark notice. 7. PRIVACY

We are committed to respecting your privacy and the security of your personal information. Our privacy policy (as of January 1st, 2009), describes the information we collect and how we use it:

Lawyer Avenue DOES NOT sell, rent or disclose our customer’s names, addresses, email addresses or other personal information. We contract with other companies to provide certain services, including credit card processing, shipping, name and address verification, and email distribution. We provide these companies with only the information they need to perform their services, and work closely with them to ensure that your privacy is respected and protected. These companies are prohibited by contract from using this information for their own marketing purposes or from sharing this information with anyone other than Lawyer Avenue. We do not otherwise disclose your information to third parties, unless required by law or in connection with a legal claim or proceeding.

We also gather information about how visitors navigate through our website by using clickstream data gathered with “cookies” and/or other online tools such as “pixel tags.” For example, we use cookies to remember what items are in your Shopping Cart, recognize you when you return to our Web site, enable you to use Express Checkout, and study how our customers navigate through our Web site, and which products you request in site searches. We also use pixel tags – tiny graphic images – to tell us what parts of our Web site you have visited or to measure the effectiveness of any searches you may do on our site. Pixel tags also enable us to send you email in a format you can read and let us know when you have opened an email message from us.

The section of Lawyer Avenue called “Concierge” provides email and Web links to external sites or resources for your convenience and reference only. Lawyer Avenue does not endorse, and is not responsible for, the availability of these external Web sites or resources or for any content, advertising, products, or other materials on or available from such external Web sites or resources. Your use of and dealings with the owners or operators of these external Web sites or resources are at your own risk. You cannot make any claim against Avenue Productions, Inc. arising out of your use of external Web sites or resources.

The products sold in the section of Lawyer Avenue called “Shops” are sold within the manufacturer’s own warranties when offered, and Lawyer Avenue itself disclaims all warranties that may relate in any way to any products listed on LawyerAvenue.com, and is not liable for their warranty claims. By purchasing products from Lawyer Avenue Shops, you agree to hold Lawyer Avenue and their respective officers, employees and agents harmless against any and all claims. Lawyer Avenue will do its best to assist its customers in such cases, by providing necessary proof of purchase and date to accommodate warranty of products when applicable.

The section of Lawyer Avenue referred to as “The Collector” acts as an online platform for site visitors to find and transact with other users, buyers or sellers (the “Users”), by purchasing a classified ad, and showcasing their items. “The Collector” is a venue designed to showcase items advertised for purchase, sale or trade. Transactions are handled directly between users, buyers, and sellers. No other monetary gains are acquired by Lawyer Avenue itself, unless Lawyer Avenue itself has posted an item. In that event, Lawyer Avenue becomes user and seller, and is bound by the same rules set forth in “The Collector” by transacting directly with interested parties.

* Lawyer Avenue does not take commission from transactions occurring within The Collector.

* Lawyer Avenue has no control over the accuracy, truth, legality, or quality of the merchandise showcased there.

* Lawyer Avenue has no control over the business practices of the sellers and the purchasing practices of the buyers.

Visitors to the site understand and agree that all transactions that occur through “The Collector” are strictly between buyer and seller, and that Lawyer Avenue has no responsibility or liability with respect to any part of the transaction or any issues related directly or indirectly to such transactions. 9. DISPUTE RESOLUTIONS

We will do our best to resolve any problems or issues that you may have with us or our services in a satisfactory manner. If, however, we are unable to reach a mutually satisfactory resolution, each of us agrees that any claim or controversy between us, or arising in any way out of the use or operation of our Web site or other services, or any information, services, products, and materials contained in this site or available through our other services, shall be resolved by binding arbitration before a single arbitrator of the American Arbitration Association (AAA) in Los Angeles, California, under the rules and procedures of the AAA. Any such dispute or controversy shall be arbitrated on an individual basis, and shall not be consolidated in any arbitration with any claim or controversy of any other party. The arbitrator shall have authority to resolve all matters in dispute between us (subject to the legal disclaimer and liability limitations set forth above), including the applicability, scope and binding effect of this arbitration agreement, and to award arbitration costs and expenses to the prevailing party as determined by the arbitrator. Notwithstanding the foregoing, either party may pursue preliminary or injunctive remedies in an appropriate state or federal court sitting in Seattle, Washington pending the decision of the arbitrator, without waiving the right or affecting the obligation to arbitrate hereunder.
